1. Agreement to Terms

By accessing or using FormAlert ("the Service"), you agree to be bound by these Terms and Conditions. FormAlert is an appointment booking and practice management platform provided by Digital Forum, operated by Aditya Das.

If you do not agree to these terms, you may not use the Service.

2. Description of Service

FormAlert provides:

• Online appointment booking and scheduling
• Video consultation capabilities
• Digital client record management
• Payment collection via integrated payment processors
• Automated notifications (WhatsApp, email, SMS)
• Professional booking pages
• Google review collection tools

3. Account Registration

To use FormAlert, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the authority to enter into this agreement
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

4. Free Trial and Subscriptions

4.1 Free Trial

• FormAlert offers a 14-day free trial for Premium features
• No credit card is required to start the trial
• Trial access ends automatically after 14 days unless you subscribe
• One free trial per user/practice

4.2 Paid Subscriptions

• Starter Plan: ₹999 per month
• Premium Plan: ₹2,499 per month
• Plans are billed monthly in Indian Rupees (INR)
• Payments are processed securely via Razorpay
• Subscriptions auto-renew unless cancelled
• All prices are inclusive of applicable taxes

4.3 Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation:

• You will retain access until the end of your current billing period
• No refunds are provided for partial months
• Your data will be retained for 30 days after cancellation
• You can reactivate within 30 days without data loss

5. Payment Processing

FormAlert integrates with Razorpay for payment collection from your clients:

• You must connect your own Razorpay account to receive payments
• FormAlert does not hold or process your client payments
• All transaction fees are determined by Razorpay
• You are responsible for compliance with payment regulations
• FormAlert is not responsible for payment disputes between you and your clients

6. User Responsibilities

6.1 Content

You are solely responsible for:

• All content you post or share through FormAlert
• Your service descriptions, pricing, and availability
• Communications with your clients
• The quality and legality of services you provide
• Compliance with all applicable laws and regulations

6.2 Prohibited Uses

You may not use FormAlert to:

• Violate any local, state, national, or international law
• Offer illegal services or products
• Impersonate others or provide false information
• Harass, abuse, or harm others
• Distribute spam, malware, or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission

7. Data and Privacy

FormAlert collects and processes data as described in our Privacy Policy:

• We store appointment data, client information, and consultation records
• You retain ownership of all data you input into FormAlert
• We use industry-standard security measures to protect your data
• You are responsible for obtaining necessary consents from your clients
• You must comply with applicable data protection laws (including Indian privacy regulations)

8. Intellectual Property

FormAlert and all associated intellectual property rights remain the property of Digital Forum:

• You receive a limited, non-exclusive license to use the Service
• You may not copy, modify, or reverse engineer any part of FormAlert
• FormAlert branding and trademarks may not be used without permission
• You retain all rights to content you create using FormAlert

9. Service Availability

While we strive for reliable service:

• We do not guarantee uninterrupted or error-free access
• Scheduled maintenance may temporarily affect availability
• We are not liable for losses due to service interruptions
• We reserve the right to modify or discontinue features with notice

10. Third-Party Services

FormAlert integrates with third-party services:

• Razorpay (payment processing)
• Twilio (WhatsApp notifications)
• Email service providers
• Video calling infrastructure

Your use of these services is subject to their respective terms and policies. FormAlert is not responsible for third-party service failures or changes.

11. Limitation of Liability

To the maximum extent permitted by law:

• FormAlert is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 3 months
• We are not responsible for the professional services you provide to clients
• We are not liable for disputes between you and your clients
• We are not responsible for losses due to data breaches beyond our control

12. Indemnification

You agree to indemnify and hold harmless FormAlert, Digital Forum, and Aditya Das from:

• Claims arising from your use of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Claims from your clients regarding services you provided
• Content you post or share through FormAlert

13. Account Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your account remains inactive for over 12 months
• Required by law or legal process
• Your usage threatens the security or integrity of the Service

Upon termination, you will lose access to your account and data after the 30-day grace period.

14. Modifications to Terms

We may update these Terms at any time:

• Changes will be posted on this page with an updated date
• Material changes will be communicated via email
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the Service

15. Governing Law

These Terms are governed by the laws of India:

• Disputes will be subject to the exclusive jurisdiction of courts in Guwahati, Assam
• You agree to submit to the personal jurisdiction of these courts
• Indian law applies without regard to conflict of law provisions

16. Professional Services Disclaimer

Important disclaimers:

• FormAlert is a software tool, not a professional service provider
• We do not verify credentials, qualifications, or licenses of users
• You are solely responsible for maintaining required certifications
• We are not involved in the professional services you provide
• Client-practitioner relationships are solely between you and your clients
